Does Apple Owe You Money For Your iCloud?

Consumer rights group Which? has launched a £3 billion legal battle against Apple, accusing the tech giant of “trapping” 40 million UK customers into its iCloud service and charging inflated prices. If successful, the lawsuit could see individual payouts averaging £70 for affected users.

The Allegations Against Apple

At the heart of the lawsuit is a claim that Apple has breached UK competition laws by giving its iCloud service preferential treatment within its ecosystem. According to Which?, this practice leaves users with few alternatives, effectively locking them into Apple’s cloud storage once they exceed the free 5GB limit provided.

“By bringing this claim, Which? is showing big corporations like Apple that they cannot rip off UK consumers without facing repercussions,” said Anabel Hoult, chief executive of Which?. She added that the legal action aims to deter similar behavior in the future and foster a more competitive market.

Which? further alleges that Apple makes it difficult for users to back up their data using third-party services, a move it says stifles competition and forces customers to pay for iCloud upgrades. Monthly iCloud pricing ranges from £0.99 for 50GB to £54.99 for 12TB of storage.

Apple’s Response: Denial and Defense

Apple has denied the accusations and vowed to “vigorously defend” its practices in court.

“Apple believes in providing our customers with choices,” a spokesperson said. “Our users are not required to use iCloud, and many rely on a wide range of third-party alternatives for data storage.” The company also claimed that nearly half of its customers don’t use iCloud and insisted its pricing is competitive with other cloud storage providers.

A Broader Battle Against Big Tech

The lawsuit against Apple is just one of many legal challenges targeting tech giants like Google, Facebook, and Samsung over alleged anti-competitive practices. Earlier this year, Google faced a landmark ruling in the US for holding an illegal monopoly in the internet search market, while similar cases are pending against its Android app store.

Toby Starr from legal firm Humphries Kerstetter described this wave of lawsuits as part of a “growing tide of large class actions against big tech.” He noted these claims could lead to significant settlements and change how tech companies operate.

What’s Next for UK Consumers?

If successful, the lawsuit could represent UK residents who’ve used iCloud since October 2015. Affected customers living abroad can opt in, while those in the UK will need to opt out if they don’t wish to be included.

Which? has called on Apple to settle without litigation and offer refunds to consumers while opening up competition in its ecosystem. Legal experts warn, however, that proving market abuse may take years as cases like this work through the courts.

With regulators globally scrutinizing cloud services, the battle over consumer rights in the tech industry is far from over. For now, Apple remains firm, dismissing Which?’s claims as “wrong on the facts and the law.”
